In case of aircraft on ground (AOG) air carriers from Non-EEA Member States may operate flights from/to Germany with subcharted/wetleased aircraft of another air carrier (Operating Carrier) without entry permission for already approved flights subject to the following conditions:
1. The Operating Carrier is an Air Carrier from an EEA Member State and holds an Operating Permit according to Regulation (EC) No. 1008/2008
or
The Operating Carrier is a German Air Carrier with the appropriate permission for exit
or
The Operating Carrier holds a TCO-Authorization of the EASA and submits a valid insurance certificate according to Regulation (EC) No. 785/2004 to the LBA.
2. The Contracting Carrier informs the LBA (Notification) prior to commencing the flight on the specific reasons for the substitute flight and names the operating carrier
or
The Operating Carrier informs the LBA directly (Notification).
3. The operation is limited to five subsequent days.
Air carriers from Non-EEA Member States, which will transport parts and equipment (e.g. engines) for an AOG-aircraft, may operate these flights from/to Germany without entry permission subject to the following conditions:
1. The Operating Carrier is an air carrier from an EEA Member State and holds an Operating Permit according to Regulation (EC) No. 1008/2008
or
The Operating Carrier is a German Air Carrier with the appropriate permission for exit
or
The Operating Carrier holds a TCO-Authorization of the EASA and submits a valid insurance certificate according to Regulation (EC) No. 785/2004 to the LBA.
2. The Contracting Carrier informs the LBA (Notification) prior to commencing the flight on the specific reasons for the substitute flight and names the operating carrier
or
The Operating Carrier informs the LBA directly (Notification)
The LBA reserves the right to demand further documents e.g. technical reports later.
