ACC3: Responsibility of the Federal Aviation Authority (LBA)

For an ACC3 designation, the Federal Aviation Authority of Germany (LBA) is pursuant to point 6.8.1.1 of the Annex to Implementing Regulation (EU) 2015/1998 responsible for

  • any air carrier that has been issued the air carrier’s Air Operator’s Certificate by the Federal Aviation Authority of Germany (LBA);
  • any air carrier as listed in the Annex to Commission Regulation (EC) No 748/2009 as amended by Regulation (EU) No 394/201 on the list of aircraft operators which had performed an aviation activity within the meaning of Annex I to Directive 2003/87/EC of the European Parliament and of the Council on or after 1 January 2006, for air carriers that do not hold an Air Operator’s Certificate issued by a Member State;
  • any air carrier that has its major base of operations in the Union in the Federal Republic of Germany, or any other appropriate authority of the Union by agreement with the Federal Aviation Authority of Germany (LBA), for air carriers not holding an Air Operator’s Certificate issued by a Member State and not listed in the Annex to Regulation (EC) No 748/2009.
