Aviation Security
With effect from 16 December 2002 the Regulation (EC) No 2320/2002 of the European Parliament and the Council came into force in Europe. The main objective of this Regulation is to establish and implement appropriate Community measures, in order to prevent acts of unlawful interference against civil aviation.
Since 15 January 2005 also the Luftsicherheitsgesetz (LuftSiG –Aviation Security Act) has been in force in Germany. The objective of this act is to protect civil aviation against terrorist action or sabotage act.
Air carriers operating aircraft exceeding 5,7 t maximum weight are obliged to apply security measures at German airports for their own protection against acts of unlawful interference and have to describe these measures in an Aiation Security Plan. According to § 16 subparagraph 3 (LuftSiG) the Aviation Security Plan must be submitted to the Luftfahrt-Bundesamt in German or in English language for approval.
All cargo, mail and express parcels intended to be carried on passenger or all-cargo aircraft shall be subjected to the security controls before being placed on board the aircraft. The air carrier is obliged to accomplish the security measures on cargo, mail and express parcels to be placed aboard an aircraft (§ 9 subparagraph 1 LuftSiG). The air carrier will exercise this power as security measures and for this purpose is subject to the guidelines (e.g. procedures, equipment, use of simulation chambers in certain cases) of the Luftfahrt-Bundesamt in accordance with § 16 subparagraph 3 LuftSiG.
For the accomplishment of the security controls, the air carrier may employ an approved „regulated agent“ or an „regulated postal service“.
During this dynamic process further Regulations have been continuously issued on the basis of Regulation (EC) No 2320/2002.
