For Air Passengers: Information about NIKI
The air carrier NIKI filed for insolvency on 13 December 2017 and stopped its flight operations as of 13 December 2017. Thus, as of this date, no more flights will be carried out under IATA Code HG.
Customers who booked their flight tickets with tour operators are requested to contact them.
Pursuant to the decision of 12 January 2018, insolvency proceedings were opened in Austria; liquidator is the lawyer Dr Ulla Reisch.
Compensation claims (e.g. compensation payments, compensation due to baggage damages, baggage loss or baggage delay or incorrect debits) must be enforced towards the operating air carrier. If NIKI was the operating air carrier of the flight, these claims, justification included, can be filed by 14 February 2018 at the local court in Korneuburg within the scope of the Austrian insolvency proceedings (GZ 36 S 5/18d). When filing the claim, a flat rate of Euro 23 must be transferred to the account of the court. Claims for the reimbursement of tickets due to flight cancellations and due to services not yet provided (e.g. additional baggage, XL seats, food not received) are only to be filed within the scope of the insolvency proceedings regarding Air Berlin’s assets provided that the flights operated by NIKI were not sold to the customers by NIKI Luftfahrt GmbH, but by Air Berlin PLC & Co Luftverkehrs KG. This applies for tickets purchased before 15 August 2017. Tickets booked after 15 August 2017 with departure date up to and including 28 February 2018 are also no longer valid. In order to determine the data and to check the matter indicating booking date, booking number, ticket number and passenger data, customers concerned should write to Flöther & Wissing, insolvency administration, or send an email with the corresponding data to firstname.lastname@example.org or use the contact form on the www.airberlin-inso.de homepage. Customers who booked their tickets after 15 August 2017 with a departure date as of 1 March 2018 will be informed separately about the further procedure by the liquidator.
